by Aaron F. Barkoff
Orange Book Blog

Paul Berghoff, Josh Rich, and I will be speaking in an FDANews audioconference next week entitled "Strategies to Defend Against Generic Drug Patent Challenges." Paul is a first-chair patent litigator who has tried numerous Hatch-Waxman cases, while Josh has spent over a decade litigating such cases. The audioconference will take place from 1:30 to 3:00 p.m. (eastern), next Wednesday, March 14--one week from today.

The audioconference will include a 60-minute presentation (with materials provided), followed by a question-and-answer session. In our presentation, we plan to cover the following topics:

fundamentals of Hatch-Waxman cases

strategies for dealing with invalidity, unenforceability, and non-infringement challenges

strategies for defending the various kinds of pharmaceutical patents (e.g., compound, method of use, formulation, etc.)

the impact of recent Supreme Court cases, including MedImmune and eBay; and

the potential impact of proposed legislation

We hope the audioconference will be useful to both innovator and generic drug companies involved in Hatch-Waxman litigation. For more information or to register, please visit the audioconference web-page.
